Performing the Jumma Salah twice in the same masjid

In our locality, there is only one small masjid. Because there are many people attending the masjid for the Jumma Salah, the congregational pray is performed two times in the masjid. People attending the masjid go back to work after the prayer. My question is: can the first congregational pray be performed before the time of Zuhr begins?

الجوابُ حامِدا ًو مُصلیِّا ً

A masjid is not a requirement for the establishment of the Jumma Salah. For this reason, the Jumma Salah can also be performed in the location mentioned in the question on the condition that it is performed in the time of Zuhr by an Imam and three people along with him. However, it is Makrooh Tahreemi (disliked) to repeat the prayer in a masjid where the Imam and the Muqtadis (those lead by the Imam in prayer) of that masjid have already performed it. This must be avoided.

مأخَذُ الفَتوی

کما فی الہندیۃ: وتؤدی الجمعۃ فی مصر واحد فی مواضع کثیرۃ وہو قول أبی حینفۃ ومحمدؒ وہو الأصح (ج: ۱/ ۱۴۵)
وفی الشامیۃ: تحت قولہ (علی المذہب) فقد ذکر الامام السرخسیؒ أن الصحیح من مذہب أبی حنیفۃؒ جواز اقامتہا فی مصر واحد فی مسجدین أو اکثر وبہ نأخذ لاطلاق ’’لا جمعۃ إلا فی مصر‘‘ شرط المصر فقط. (ج: ۲/ ۱۴۵)
وفی البحر الرائق: تحت قولہ (وتؤدی الجمعۃ فی مواضع) أی أداء الجمعۃ فی مصر واحد بمواضع کثیرۃ وہو قول أبی حنیفۃ ومحمد رحمہما اللہ تعالٰی وھو الأصح لأن فی الاجتماع فی موضع واحد فی مدینۃ کبیرۃ حرجًا بینًا. (ج: ۲/ ص ۱۴۲)
وفی تنویر الابصار: ویشترط لصحتہا المصر وہو ما لا یسع اکبر مساجدہ أہلہ المکلفین بہا (الی قولہ) والسلطان أو مأمؤرہ بإقامتہاا الخ. (ج: ۲/ ۱۳۷)
وفی الشامیۃ: تحت قولہ (قولہ تغلق) لئلا تجتمع فیہا جماعۃ بحر عن السراج (قولہ إلا الجامع) أی الذی تقام فیہ الجمعۃ فإن فتحہ فی وقت الظہر ضروری والظاہر أنہ یغلق أیضًا بعد اقامۃ الجمعۃ لئلا یجتمع فیہ أحد بعدہا. (ج: ۲ ص: ۱۵۷)۔ واللہ اعلم
