Can One Drink Soft Cold Drinks and Mint Tea While in the State of Ihram?

Assalamu Alaikum wa Rahmatullahi wa Barakatuh! In the state of ihram, is it permissible to drink beverages such as Pepsi or 7-Up, and to drink tea containing mint leaves? Does this make a dam or sadaqah obligatory?

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clear that beverages such as Pepsi, 7-Up, and tea containing mint leaves are like ordinary drinks. They do not contain any fragrance; rather, they simply have a specific taste. Therefore, drinking them while in the state of ihram does not make any dam or sadaqah obligatory.

مأخَذُ الفَتوی

کما فی غنیۃ الناسک: و لا بأس بأن یتکلم فیہ بکلام یحتاج إلیہ بقدر الحاجۃ، و یشرب و یفعل کل ما یحتاج إلیہ الخ (فصل و أما مباحات الطواف، ص: 125، ط: ادارۃ القرآن و العلوم الاسلامیۃ)۔
و فیھا ایضاً: و لہ أکل طعام (الی قولہ) و أکل الزیت، و الشیرج، و إستعاطھما، و التداوی بھما الخ (فصل فی مباحات الاحرام، ص: 93، ط: ادارۃ القرآن و العلوم الاسلامیۃ)۔
