Respected Hazrat, Assalamu Alaikum !My issue is that I have four daughters and one son. All four daughters and the son are married. I own a flat in which I currently live with my son. This flat was given to me by my brother at the time of my marriage, with some installments remaining, which were later paid by my husband. I now wish to transfer this flat to my son’s name. I have consulted my daughters regarding this matter, and they have happily agreed that I may transfer the flat to my son’s name during my lifetime. In this regard, I humbly request your guidance.
Although the questioner may, without any coercion, give the entire house to her son, it is not sufficient merely to transfer it to his name; rather, it is also legally required in Shariah to hand over formal ownership and possession so that the son’s ownership is established. However, the correct and preferable course is that the daughters should not be completely deprived, but that they too should be given something, so that she may avoid sin.
کما في الدر المختار: (وتتم) الهبة (بالقبض) الكامل (ولو الموهوب شاغلا لملك الواهب لا مشغولا به) اھ(5/ 690)۔
و في الفتاوى الهندية: ولو وهب رجل شيئا لأولاده في الصحة وأراد تفضيل البعض على البعض في ذلك (إلی قوله) أنه لا بأس به إذا كان التفضيل لزيادة فضل له في الدين وإن كانا سواء يكره وروى المعلى عن أبي يوسف رحمه الله تعالى أنه لا بأس به إذا لم يقصد به الإضرار وإن قصد به الإضرار سوى بينهم يعطي الابنة مثل ما يعطي للابن وعليه الفتوى هكذا في فتاوى قاضي خان وهو المختار كذا في الظهيرية رجل وهب في صحته كل المال للولد جاز في القضاء ويكون آثما فيما صنع كذا في فتاوى قاضي خان اھ (4/ 391) واللہ اعلم بالصواب!
