What do the esteemed Muftis say regarding the following issue: The deceased, Alko Muhammad son of Abdul Rahman, owned property in the area of Deh Mai Garhi, Manghopir. He was survived by the following heirs: (1) Sadiq S/O Alko Muhammad (2) Alauddin S/O Alko Muhammad (3) Naseem S/O Alko Muhammad (4) Rozi S/O Alko Muhammad (predeceased his father) (5) Khadija D/O Alko Muhammad (6) Jameela D/O Alko Muhammad (7) Shazia D/O Alko Muhammad
The deceased Rozi S/O Alko Muhammad passed away before his father. Now, Rozi’s daughter, Shama D/O Rozi, is claiming a share in the inheritance of her paternal grandfather (Alko Muhammad). The question is: Will Rozi, who passed away during his father's lifetime, be entitled to a share in the inheritance? Will his daughter, Shama, receive any share in the estate according to Islamic law?
Since the deceased Rozi Muhammad passed away during his father's lifetime, his daughter is not entitled to any share in her grandfather’s inheritance in the presence of her paternal uncles. Therefore, Miss Shama is not eligible to inherit and must withdraw her claim. However, if her paternal uncles voluntarily wish to give her something from their own shares, they are permitted to do so.
