Ruling on the fees levied for the late payment of installments

What is the legal status in the Shari’ah of the amount that is levied for the delayed payments of installments on a plot of land?

الجوابُ حامِدا ًو مُصلیِّا ً

It is Haram and unlawful, and must be avoided.
And Allah knows best.

مأخَذُ الفَتوی

فی مشکٰوۃ المصابیح: عن أبی حرۃ الرقاشی عن عمّہ قال قال رسول اللہﷺ ألا لا تظلموا لا یحل مال إمرئ إلا بطیب نفس منہ اھ (ص: ۲۵۵)
فی البحر: والحاصل أن المذہب عدم التعزیر بأخذ المال (ج:۵ ص: ۴۱ طبع ماجدیہ)
وہکذا فی رد المحتار أیضا (ج: ۴ ص: ۶۲) واللہ تعالیٰ اعلم
