Losing team purchasing drinks for both teams

We play volley ball with the condition that the losing team must buy drinks for the players of both teams. After the match, the losing team gathers money and the winning team also contributes so that it would not be considered as gambling. Will this also be counted as gambling?

الجوابُ حامِدا ًو مُصلیِّا ً

This is also a form of gambling, and must be avoided.

مأخَذُ الفَتوی

ففی الدر المختار: (إن شرط المال) في المسابقة (من جانب واحد وحرم لو شرط) فيها (من الجانبين) لأنه يصير قمارا اھ(6/ 403)
وفی تکملۃ فتح الملھم: تحت مسئلۃ سباق الخیل والمراھنۃ علی ذلک والصورۃ الثالثۃ: أن یکون المال من الجانبین بأن یقول ان سبقتنی فلک علی کذا، وإن سبقتك فلی علیك کذا فہذا حرام بالإجماع الخ (۳/۳۹۰)
