Selling wooden sculptures or toys of living things to a Non-Muslim

Will it be permissible for a Muslim to sell wooden sculptures of animals or personified toys to a Non-Muslim who would then use it for his own religious customs, such as worship, black magic etc.?

الجوابُ حامِدا ًو مُصلیِّا ً

It is Haram and unlawful as per Shari’ah to sell a picture or a sculpture of any living thing in which the face, having all of its limbs, is included, especially if one is sure that it will be used for ritualistic proposes or black magic. For this reason, one must refrain from selling sculptures or toys of animals or humans.

مأخَذُ الفَتوی

فی أحکام القرآن للجصاص: تحت قول اللہ تعالیٰ: ﴿ولا تعاونوا علی الإثم والعدوان﴾ نھی عن معاونۃ غیرنا علٰی معاصی اللہ تعالٰی۔ اھـ (ج٢، ص٣٠٣)۔
وفی الدر المختار: قلت: قدمنا ثمۃ معزیًا للنھر أن ما قامت المعصیۃ بعینہ یکرہ بیعہٗ تحریمًا والإفتنزیھًا، فلیحفظ توفیقًا۔ اھـ (ج٦، ص٣٩١)۔
وفی فقہ البیوع: ویدخل فی ہذا القسم (بیع اٰلات الملاھی) بیع الأصنام والصور المجسدۃ (إلی قولہ) فبیع غیر المجسدۃ ممنوع فی مذھب الجمھور ویدل علٰی ذلک أن رسول اللہ ﷺ حرم بیع الأصنام۔ اھـ (ج١ ص٣٢٠) واللہ أعلم بالصواب
