I want to adopt my brother’s new born baby

I want to adopt my brother’s new born baby

I want to adopt my brother’s new born baby. I have three daughters. My question is that will the adopted child be marriageable to my daughters? And, if my wife breastfeeds this baby, will he be marriageable to my daughters or not?

الجوابُ حامِدا ًو مُصلیِّا ً

The questioner’s nephew, who the questioner wants to adopt, will be marriageable to the questioner’s wife and daughters when he reaches the age of puberty. However, if the questioner’s wife breastfeeds him during the breastfeeding period (i.e. during the first two years of his life), then he will be the foster son of the questioner and his wife and the foster brother of the questioner’s daughters, and after the age of purity, he will not be marriageable to the questioner’s wife and daughters.

مأخَذُ الفَتوی

کقولہ تعالیٰ: وإذا بلغ الأطفال منكم الحلم فليستأذنوا كما استأذن الذين من قبلهم… (سورۃ النور: ۵۹)۔

وقال تعالیٰ: وما جعل أدعياءكم أبناءكم ذلكم قولكم بأفواهكم… (سورۃ الاخزاب: ۴)۔

وفی الفتاویٰ الھندیۃ: يحرم على الرضيع أبواه من الرضاع وأصولھما وفروعھما من النسب والرضاع جميعا حتى أن المرضعة لو ولدت من هذا الرجل أو غيره قبل هذا الإرضاع أو بعده أو أرضعت رضيعا أو ولد لھذا الرجل من غير هذه المرأة قبل هذا الإرضاع أو بعده أو أرضعت امرأة من لبنه رضيعا فالكل إخوة الرضيع وأخواته وأولادهم أولاد إخوته وأخواته وأخو الرجل عمه وأخته عمته وأخو المرضعة خاله وأختھا خالته اھـ(ج۱ ص۳۴۳ ماجدیہ)۔ واللہ اعلم بالصواب۔
