What do the Muftis and learned scholars say about the issue that a few of us have formed a BC (bachath committee) of fifty (50,000) thousand rupees. This committee is number-wised. One colleague has the last number, and the other colleague has the sixth number. The one who is sixth wants to give his turn to the one who got the last turn. He, in turn, if wishes to give some money to the sixth to end the burden of his favor, will this be considered usury or not?
If the matter of giving and taking is not familiar and conditional, then it appears to be a possibility, but yet, it is better to avoid it.
كما في شرح الوقاية: وشرعاً: (فَضْلٌ خَالٍ عَنْ عِوَضٍ) أي لا يقابله عوض في معاوضة مالٍ بمالٍ (شُرِطَ لأحَدِ المُتَعَاقِدَيْنِ في المُعَاوَضَةِ). أي فَضْلَ أحد المتجانسين على الآخر اھ(2/ 143)۔
