Respected Mufti Sahib, Assalamu Alaikum wa Rahmatullahi wa Barakatuh!
Mufti Sahib, please inform me what are the Quranic verses and Hadiths that mention the prohibition of smuggling intoxicating substances such as wine, hashish, opium, and cannabis?
It should be clearly understood that smuggling whether of intoxicating substances or any other goods is unlawful (haram) due to its being a violation of the country’s laws. Moreover, this is a broad and detailed subject on which scholars have done extensive work. Therefore, it is better that whenever the need arises, one should seek the specific Shariah ruling regarding the particular matter in question.
کمافی تکملۃ فتح الملھم: قال شیخ الاسلام۔حفظہ اللہ تعالیٰ۔ان المسلم یجب علیہ ان یطیع امیرہ فی الامور المباحۃ فان امر الامیر بفعل مباح وجبت مباشرتہ وان نھی عن امر مباح حرم ارتکابہ،لان اللہ سبحانہ وتعالیٰ قال: اطیعوا اللہ واطیعوا الرسول واولی الامر منکم (الیٰ قولہ) ومن ھنا صرح الفقھاء بان طاعۃ الامام فیما لیس بمعصیۃ واجبۃ اھ(3/323)۔
