What do the honorable Muftis say regarding the following issue that at times, during the slaughter of an animal, it so occurs that a Muslim of sound mind recites Bismillah and commences the slaughter. However, due to lack of skill, or because it is his first attempt, he completely severs (cuts) only two veins (such as the trachea and the esophagus) and cuts only part of the third vein, then stops. Thereafter, another person present immediately steps forward and severs the remaining veins without reciting Bismillah. The question is: what is the Shari ruling concerning the permissibility of such an animal?
In the case under discussion, if at the time of slaughter, the slaughterer has fully severed two veins (the trachea and the esophagus) and has cut most of the third vein, then in such a situation the act of slaughter is deemed complete and the animal becomes lawful (halal). Thereafter, if another person, while assisting the slaughterer, severs the remaining portion of the third vein and the fourth vein without reciting Bismillah, this does not render the animal unlawful (haram). However, as a matter of precaution, he too should recite Bismillah.
كما في الدر المختار: (وحل) المذبوح (بقطع أي ثلاث منها) إذ للأكثر حكم الكل وهل يكفي قطع أكثر كل منها؟ خلاف وصحح البزازي قطع كل حلقوم ومريء وأكثر اھ (6/ 295)۔
و في حاشية ابن عابدين؛ (قوله وصحح البزازي إلخ) عبارته: أصح الأجوبة في الأكثر عنه: إذا قطع الحلقوم والمريء الأكثر من كل ودجين يؤكل وما لا فلا اهـ. (6/ 295)۔
و في بدائع الصنائع: وللأكثر حكم الكل فيما بنى على التوسعة في أصول الشرع والذكاة بنيت على التوسعة حيث يكتفي فيها بالبعض اھ (5/ 42)۔
و في الدر المختار: وفيها أراد التضحية فوضع يده مع يد القصاب في الذبح وأعانه على الذبح سمى كل وجوبا، فلو تركها أحدهما أو ظن أن تسمية أحدهما تكفي حرمت (6/ 334)-
