The Shariah Ruling on Digital Photography

Assalamu Alaikum wa Rahmatullahi wa Barakatuh!
Mufti Sahib, I am faced with an issue. The issue is: Is it permissible to take or have taken a picture through a mobile phone, camera, or digital camera? And it is said that all of this is like a mirror image. Kindly provide clarification in the light of the Qur’an and Hadith. Thank you.

الجوابُ حامِدا ًو مُصلیِّا ً

Making or having pictures made is, in both cases, impermissible and unlawful (haram) in Shari‘ah, and there are severe warnings mentioned in the noble hadith regarding both of these matters. However, according to our research, digital photography does not fall under the category of prohibited pictures as long as it is not printed out—whether it appears on a mobile or computer screen, or on a television screen. Nevertheless, if such pictures consist of non-mahram individuals or other unlawful content, then just as it is not permissible to view them in reality, it is likewise impermissible to view them on a TV, computer, or mobile screen.

مأخَذُ الفَتوی

ففی مشكاة المصابيح: وعن عبد الله بن مسعود قال: سمعت رسول الله صلى الله عليه وسلم يقول: «أشد الناس عذابا عند الله المصورون» اھ (2/ 1274)۔
و في تكملة من الملهم: أما التلفزيون والفدیو، فلاشك في حرمة استعمالها بالنظر إلى ما يشتملان عليه من المنكرات الكثيرة (إلی قوله) ولكن ليس لها ثبات ولا استقرار على الشاشة وانما هي تظهر وتفنی اھ (إلی قوله) الصورة لا تستقر على الكيمرا، ولا على الشاشة وانما هي اجزاء كهربائية تنتقل من الكيمرا إلى الشاشة وتظهر عليها بترتيبها الاصلى ثم تفنی وتزول وأما إذا احتفظ باالصورة في شريط الفيديو فان الصور لا تنقش على الشريط وانما تحفظ فيها الاجزاء الكهربائية التي ليس فيها صورة فاذا ظهرت هذه الاجزاء على الشاشة ظهرت مرة اخرى بذلك الترتيب الطبيعي ولكن ليس لها ثبات ولا استقرار على الشاشة وإنما هي تظهر و تفنى فلا يبدوان هناك مرحلة من المراحل تنتقش فيها الصورة على شئى بصفة مستقرة أو رائمة وعلى هذا فتنزيل هذه الصورة منزلة الصورة المستقرة مشكل اھ (۱۶/۱۶۴، ۱۶۵) ۔
