Assalamu Alaikum! The house whose distribution is mentioned below was built through the hard work and labor of all of us brothers; it is not an inheritance from our late father.
We are six brothers, two sisters, and our mother, and we now wish to distribute this house. We want to determine the value of the house according to its current market price and divide it accordingly. Kindly provide us with the method of distribution in accordance with the Qur'an and Sunnah.
If the description of the situation is indeed accurate and based on facts, and the brothers now genuinely wish to distribute this house among themselves regardless of who spent more or less on it, then the best method is to divide it into nine equal shares, giving each of the six brothers, two sisters, and the mother one share each along with formal ownership and possession. If physically dividing the house into nine parts makes it unfit for living, then the division can be considered conceptual, and the property treated as jointly owned by all nine parties. This arrangement should also be documented in writing. Alternatively, if every individual already has separate housing arrangements, then the house can be sold, and its value distributed equally into nine parts, giving each of the heirs their respective share in cash.
