Ruling on Benefiting from an Offer for Activating an Inactive SIM Card

What do the esteemed muftis say regarding the following matter: Under the “Zong SIM Lagao” offer, if a SIM card that has been inactive for one month is put into use and a load of 50 rupees is made, then for two months Zong-to-Zong calls become completely free, and 2 GB of internet data is also provided free of charge. If a person buys two SIM cards with the intention that he will activate this package on one SIM while keeping the other inactive, and then after one month activate the package on the second SIM, in this way he will always have access to this facility. It is common for Zong to deduct the 50 rupees gradually even without use, while in Telenor this facility is available without adding 50 rupees, with the condition that there must already be some balance in the SIM, no matter how much.

الجوابُ حامِدا ًو مُصلیِّا ً

It is permissible and valid for a customer to benefit from the offer given by the mentioned companies for reactivating an inactive SIM card, provided that it is allowed by the company.

کمافي البحر الرائق: كتاب الهبة هي لغة التفضل على الغير بما ينفعه ولو غير مال واصطلاحا ما أشار إليه المصنف قوله ( هي تمليك العين بلا عوض ) (إلی قوله) وسببها إرادة الخير للواهب دنيوي كالعوض وحسن الثناء والمحبة من الموهوب له اھ (7/ 284)۔
وفي قضايا فقهية معاصرة : وبما ان حقيقة الجائزة انها هبة بدون مقابل، فانها ليست من عقود المعاوضة ، وانما هي من قبيل التبرعات فمن شروط جوازها ان تكون تبرعا من المجيز بدون ان يلتزم المجاز بدفع عوض مالی مقابل الجائزة اھ (۲/۱۵۵)۔
