What do the honorable scholars and muftis say regarding this matter: if a person has caused damage to public property (national assets) and now wishes to make amends, while there is no established Shar‘i government, then what will be the method of compensation?
Note: By “public property” it is meant, that the person had taken some items such as school furniture, tables, chalk, dusters, etc., from a government school, and those items are no longer in his possession. Kindly explain the proper Shar‘i method for him to be absolved from this sin.
It is obligatory upon the questioner to sincerely repent and seek forgiveness for this sin, and, in whatever possible manner, return the mentioned items or their equivalent value to the authorized officials of the said school, so that he may also be absolved from accountability in the Hereafter.
کما الدرالمختار: (ويجب رد عين المغصوب) (في مكان غصبه) (ويبرأ بردها ولو بغير علم المالك) (أو) يجب رد (مثله إن هلك وهو مثلي وإن انقطع المثل) بأن لا يوجد في السوق الذي يباع فيه وإن كان يوجد في البيوت ابن كمال (فقيمته يوم الخصومة) أي وقت القضاءالخ (6 /182)۔
