I am under the influence of evil-eye

Assalamu Alaikum! Mufthi Sahib I want to know that; often my health becomes weak all of a sudden and my mother use to expel the effect of evil-eye and then I recover to a quite an exent too. My mothers opinion is that I am under the influence of evil-eye, therefor she has made a Tha'weez and brought for me in which Sura e Yaseen is kept under a piece of leather and stitched. And now she wants me to wear it around the neck. And now you inform me whether evil-eye etc. are correct from the Islamic point of view or no? And the Tha'weez will have to be kept always around the neck and it is not possible to remove it on and off. Is it correct to wear it and bathe or go to the toilet or no? Please explain in detail and if possible quote refernces from Qur'an, Hadees or Seerath of Nabi Sallallahu Alaihi wa Sallam. May Allah reward you. Aameen! Allah Hafiz. Fee Amanillah

الجوابُ حامِدا ًو مُصلیِّا ً

Influence of evil-eye is truth and it is permissible too to make Tha’weez and wear it around the neck. Therefore, there is no harm in wearing a Tha’weez of Sura e Yaaseen and going to the toilet etc. if it is covered inside leather.

مأخَذُ الفَتوی

کمافي سنن الترمذي: عن عبيد بن رفاعة الزرقي، أن أسماء بنت عميس قالت: يا رسول الله، إن ولد جعفر تسرع إليهم العين أفأسترقي لهم؟ فقال: «نعم، فإنه لو كان شيء سابق القدر لسبقته العين» اھ(4/ 395)
و في مراقي الفلاح شرح نور الإيضاح: ويكره الدخول للخلاء ومعه شيء مكتوب فيه اسم الله أو قرآن اھ (ص: 28)
و في حاشية الطحطاوي على مراقي الفلاح شرح نور الإيضاح: ثم محل الكراهة إن لم يكن مستورا فإن كان في جيبه فإنه حينئذ لابأس به اھ (ص: 54)
