The Shariah ruling on publishing the Qur’an printed by Taj Company without the permission of its copyright holder.

What do the respected scholars say regarding the following issue that we wish to print a copy of the Qur’an in the script of Taj Company, which has now ceased its business. We do not intend to gain any worldly profit from its sale; rather, In shaa Allah, we plan to contribute a few rupees per copy from our own side and sell it at a lower price than the actual cost. Although such copies of the Qur’an are under copyright protection, many publishers have already reproduced them by making copies (films) and are profiting from them. In our case, would there be any sin in this act, and would we be answerable before Allah, the Exalted?

الجوابُ حامِدا ًو مُصلیِّا ً

Since the copyright of this company is protected, and repeated announcements of prohibition have been issued by its owners, it is therefore necessary to refrain from publishing it without permission.

مأخَذُ الفَتوی

کما في سنن أبي داود: أسمر بن مضرس، قال: أتيت النبي صلى الله عليه وسلم فبايعته، فقال: «من سبق إلى ماء لم يسبقه إليه مسلم فهو له» اھ (3/ 177)۔
و في الفقه الإسلامي وأدلته للزحيلي: وبناء عليه يعتبر إعادة طبع الكتاب أو تصويره اعتداء على حق المؤلف، أي أنه معصية موجبة للإثم شرعاً، وسرقة موجبة لضمان حق المؤلف في مصادرة النسخ المطبوعة عدواناً وظلماً، وتعويضه عن الضرر الأدبي الذي أصابه. وذلك سواء كتب على النسخ المطبوعة عبارة: (حق التأليف محفوظ للمؤلف) أم لا، لأن العرف والقانون السائد اعتبر هذا الحق من جملة الحقوق الشخصية اھ (4/ 2862)۔
