Assalamu Alaikum, Mufti Sahib! I bought a Honda 125 CG motorcycle for 235,000 rupees. Later, I gave it to my friend because he was in need of money. He then sold that motorcycle for 210,000 rupees. It had been agreed between us that whenever he got money after three or four months, he would buy me a new motorcycle, regardless of whether the motorcycle’s price increased or decreased. Now, the current price of the new motorcycle is 238,900 rupees. My question is: can I take the amount equal to the price of the new motorcycle from him instead of taking the motorcycle itself? If I take the money equivalent to the price of a new motorcycle, would it be considered interest (riba) or not? Please guide me in this matter
In the described case, the transaction between the questioner and his friend regarding the motorcycle was invalid (fasid) according to Shari‘ah. This is because the questioner did not sell the motorcycle to his friend for a fixed price; rather, he made it a condition that his friend would give him a new motorcycle after three or four months. In Shari‘ah, such a transaction is invalid due to the uncertainty (jahalat) of the price (thaman) and the undetermined time of payment. Since the transaction was invalid, and the friend has already sold that motorcycle to someone else, he is not obligated to provide the questioner with a new motorcycle or its current market value. However, the friend must pay the questioner the price of the motorcycle at the time it was given to him.

حكم البيع الفاسد أنه يجب على المتعاقدين فسخُه، ولكنّه يفيد ملكا خبيثا بعد قبض المشتري المبيع ، ويتفرّع عليه أمور آتية: . . . إن لم يبق المبيعُ في يد المشتري في البيع الفاسد، بأن هلك في يده ، أو تصرّف فيه تصرّفا يمنع الردّ، فإنه يضمن للبائع مثلَه أو قيمتَه، ويستردّ الثمن.(ص:1194، ج:2، ط:مكتبة معارف القران)
