Ruling on Printing Images in Printing Work

Assalamu Alaikum wa Rahmatullahi wa Barakatuh! Respected Sir, I work in the printing business. I print packaging for hair henna products, which contains a human image. My client is a very pious, noble person associated with the Tablighi Jamaat. Due to market trends and the need to prevent copying (imitation) of the product, he is using this image, as the copyright of this picture also belongs to him. If the image is not included, the product can easily be copied. I want to know whether printing such products that contain pictures is permissible in Shari‘ah under these circumstances. Kindly guide me at your earliest convenience. May Allah reward you with goodness.

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clear that creating images of living beings and printing them is not permissible in Shari‘ah; rather, it is a major sin, and severe warnings have been mentioned regarding it in the noble ahadith. Therefore, it is not permissible for the questioner to print any packaging that contains images of living beings. Hence, if a customer includes images of living beings in their printing design, it would not be permissible for the questioner to accept such orders. However, in cases where the images of living beings are not clearly visible—such as when the facial features have been blurred—then in such a situation it is permissible for the customer to have such printing done, and it is permissible for the questioner to print it for them as well.

مأخَذُ الفَتوی

کمافی مشکوۃ المصابیح: عن عائشۃ رضی اللہ عنھا ان النبی ﷺ قال:اشد الناس عذابا یوم القیٰمۃ الذین یضاھون یخلق اللہ متفق علیہ۔الحدیث(ج2 صـ385 باب التصاویر ط: قدیمی کتب خانہ)۔
وفی مرقاۃ المفاتیح: قال اصحابنا وغیرھم من العلماء: تصویر الحیوان حرام شدید التحریم وھو من الکبائر لانہ متوعد علیہ بھذا الوعید الشدید المذکور فی الاحادیث، سواء صنعہ فی ثوب، او بساط، او درھم، او دینار، او غیر ذلک الخ(8 صـ266 باب التصاویر ط: حقانیۃ)۔
وفی تکملۃ فتح الملھم: قال الرداوی فی الانصاف (1/474)"یحرم تصویر مافیہ روح، ولایحرم تصویر الشجر، ونحوہ، والتمثال مما لایشابہ مافیہ روح، علی الصحیح من الذھب ۔۔۔۔یحرم تعلق مافیہ صورۃ حیوان، وستر الجدار بہ، وتصویرہ علی صحیح المذھب" وبمثلہ قال: ابن قدامۃ فی المغنی(7/7) کتاب الولیمۃ الخ (ج4 صـ159 کتاب اللباس والزینۃ باب تحریم تصویر صورۃ الحیوان ط: دارالعلوم کراتشی)۔
ففي الدر المختار: (ولبس ثوب فيه تماثيل) ذي روح اھ(1/ 647)۔
وفي الدر المختار وحاشية ابن عابدين: تحت: (قوله ولبس ثوب فيه تماثيل) (إلی قوله) وظاهر كلام النووي في شرح مسلم الإجماع على تحريم تصوير الحيوان، وقال: وسواء صنعه لما يمتهن أو لغيره، فصنعته حرام بكل حال لأن فيه مضاهاة لخلق الله تعالى، وسواء كان في ثوب أو بساط أو درهم وإناء وحائط وغيرها اهـ (1باب مایفسد الصلاہ وما یکرہ فیھا، ج: 1، ص: 647، ط: سعید)-
وفي خلاصة الفتاویٰ: وإن کانت مفقطوع الرأس لا بأس به وکذا لو محی وجه الصورة فھو کقطع الرأس (إلی قوله) وإن کانت صغیرة لا تبدو للناظرین من بعید لا بأس به ثم التمثال إذا کان علی وسادة أو بساط لابأس باستعمالھا وإن کان یکره اتخاذ ھما لکن لا یسجد علی الصورة اھ (ج: 1، ص: 58)۔
