Company is in Israel. Is working through this company permissible

Fiverr.com is a company that provides opportunities for freelancing, through which English people and Arabs work, but the head office of this company is in Israel. Is working through this company permissible and Halal?

الجوابُ حامِدا ًو مُصلیِّا ً

Freelancing is an English word comprised of two separate words: free, and lancing. It means earning money without being a worker of any specific company, rather by providing one’s services to different industries, companies, individuals etc. through freelancing websites.
Freelancing companies make policies, which are usually found on their website, in order for them to profit. One can provide his services on the website for a specific period of time. If someone has some sought of skill or talent, he can become a member and undertake different projects available on the website. Similarly, if someone is in need of any specific service, he can also hire a freelancer through the website to work for him.
In terms of Islamic judicial perspective, because the mentioned procedure is that of Ijarat, there is no harm in companies making a profit through these services or in becoming a member of these companies, on the condition that the payment, task and work period etc. be specified. However, there are different types of projects on freelancing websites, of which some are not approved of by the Shari’ah (like music, performing, dancing etc.). Earning through such projects is not permissible.

مأخَذُ الفَتوی

کما فی الدر المختار: وفی الأشباہ: استعان برجل فی السوق لیبیع متاعہ فطلب منہ اجرًا فالعبرۃ لعادتہم، وکذا لو ادخل رجلًا فی حانوتہ لیعمل لہ۔ الخ (ج۶، ص۴۲)

وفی الہندیۃ: ومنہا ان یکون المعقود علیہ وہو المنفعۃ معلوما علما یمنع المنازعۃ فان کان مجہولا جہالۃ مفضیۃ الی المنازعۃ یمنع صحۃ العقد والآفلا۔ الخ (ج۴، ص۴۱۱)۔

وفیہا ایضا: واما بیان انواعہا فنقول انہا نوعان نوع یرد علی منافع الاعیان کاستئجار الدور والاراضی والدواب والثیاب وما اشبہ ذلک ونوع یرد علی العمل کاستئجار المحترفین للاعمال کالقصارۃ والخیاطۃ والکتابۃ وما اشتبہ ذلک کذا فی المحیط واما حکمہا فوقوع الملک فی البدلین ساعۃ فساعۃ الا بشرط تعجیل الاجرۃ واما کیفیۃ انعقادھا فالاجارۃ عندنا تنعقد فیما بین المتعاقدین للحال وتنعقد ساعۃ فساعۃ فی حق الحکم وھو الملک علی حسب حدوث المنفعۃ کذا فی محیط السرخسی۔ الخ (ج۴، ص۴۱۱) واللہ اعلم بالصواب
