Performing Hajj by Taking a Loan

It has been three years since my father passed away, but the inheritance has not yet been divided among the brothers. Can I perform my obligatory Hajj by taking a loan?
Note: After contacting the questioner, it was found that the amount being given for Hajj is actually part of his rightful share from the inheritance, not a loan.

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clear that after the death of a deceased person, all heirs become rightful owners of their respective shares of the inheritance according to Islamic law. The elders should ensure that the estate is distributed among all the heirs as soon as possible and should not delay it without a valid reason. Therefore, in the mentioned case, the questioner’s brothers should immediately distribute the inheritance among all heirs according to their lawful shares. As for the questioner’s Hajj, if he has already received an amount from his inheritance sufficient to cover the expenses of Hajj, then he should use that money instead of taking a loan. However, if he takes a loan and is capable of repaying it later, then performing Hajj with borrowed money is also permissible in Shari‘ah.

مأخَذُ الفَتوی

کما فی الھندیۃ: وتفسیرہ ملک الزاد والراحلۃ أن یکون لہ مال فاضل عن حاجتہ وھو ما سوی مسکنہ ولبسہ وخدمہ وأثاث بیتہ قدر ما یبلغہ الی مکۃ ذاھبا وجائیا راکبا لا ماشیا وسوی مایقضی بہ دیونہ ویمسک النفقۃ عیالہ ومرمۃ مسکنہ ونحوہ الی وقت انصرافہ کذا فی محیط السرخسی الخ (کتاب المناسک۔ ج1،ص217، ط: ماجدیۃ)۔
وفی الدر المختار : ( ذی زاد )یصح بہ بدنہ فالمعتاد اللحم ونحوہ اذا قدر علی خبز وجبن لا یعد قادراً (وراحلۃ) مختصۃ بہ الخ
وفی الشامیۃ تحت : ( قولہ ذی زاد وراحلۃ ) أفاد أنہ لایجب الا بملک الزاد وملک أجرۃ الراحلۃ فلا یجب بالاباحۃ او العاریۃ کما فی البحر (قولہ مختصۃ بہ) فلا یکفی لو قدر علی راحلۃ مشترکۃ یرکبھا مع غیرہ بالمعاقبۃ شرح اللباب الخ (کتاب الحج،2،ص459، ط: سعید )۔
وفی مجمع الانھر : ( وقدرۃ زاد وراحلۃ ) وھما من شروط الوجوب عند الفقھاء وقال فی الفتح ان القدرۃ علی الزاد والراحلۃ شرط الوجوب لا نعلم عن احد خلافہ ومرادہ عن احد من الفقھاء الخ ( کتاب الحج، ج1،ص261، ط: دارلاحیاء التراث العربی)۔
