Making a bequest of a sick person to pay Fidya on his missed fasting

What do the respected Muftis say regarding the following matter?
A boy had been ill for a long time, and during his illness he missed some fasts. Since he did not recover, he never had an opportunity to make up the missed fasts, and he eventually passed away while still suffering from the same illness.
During his illness, the boy had also made a bequest (wasiyyah) to pay fidyah for the missed fasts. The question is: Is fidyah actually due from him, or not?
Kindly provide an answer in the light of the Qur’an and Sunnah. Jazakallah Khaira

الجوابُ حامِدا ًو مُصلیِّا ً

If the aforementioned boy passed away while still suffering from the illness, before recovering from it, and did not have an opportunity to make up the missed fasts, then in such a case, according to Islamic law, it was not obligatory upon him to pay fidyah for the fasts that remained due from him, nor was he required to make a bequest regarding it. Therefore, it is not necessary to act upon the deceased’s bequest now.

مأخَذُ الفَتوی

کما في الدر المختار: (فإن ماتوا فيه) أي في ذلك العذر (فلا تجب) عليهم (الوصية بالفدية) لعدم إدراكهم عدة من أيام أخر (ولو ماتوا بعد زوال العذر وجبت) الوصية بقدر إدراكهم عدة من أيام أخر، وأما من أفطر عمدا فوجوبها عليه بالأولى (وفدى) لزوما (عنه) أي عن الميت (وليه) الذي يتصرف في ماله (كالفطرة) قدرا (بعد قدرته عليه) أي على قضاء الصوم (وفوته) أي فوت القضاء بالموت فلو فاته عشرة أيام فقدر على خمسة فداها فقط (بوصيته من الثلث) اھ (2/ 424)
و في الفتاوى الهندية: ولو فات صوم رمضان بعذر المرض أو السفر واستدام المرض والسفر حتى مات لا قضاء عليه لكنه إن أوصى بأن يطعم عنه صحت وصيته وإن لم تجب عليه ويطعم عنه من ثلث ماله فإن برئ المريض أو قدم المسافر وأدرك من الوقت بقدر ما فاته فيلزمه قضاء جميع ما أدرك فإن لم يصم حتى أدركه الموت فعليه أن يوصي بالفدية كذا في البدائع اھ (1/ 207) و الله اعلم بالصواب
