Matters with regard to Marriage

Assalamu Alaikum Wa Rahmathullaahi wa Barakaathuhu
This is to inform that, the son of Bibi Saleha, whose name is Naz Muhammad Dad, has been suckled by a scarlet woman whose daughter is Hanifa and son is Muhammad Hasan. Muhammad Hassan has been suckled by Bibi Saleha. Now, marriage between Naz Muhammad Dad and Hanifa is permissible or not? Wheras Naz Muhammad Dad and Hanifa have not been suckled by each other's mothers.

الجوابُ حامِدا ًو مُصلیِّا ً

In the case mentioned, if Naz Muhammad has not been suckled by the scarlet woman during the period of suckling, and Hanifa too, was not suckled by Bibi Saliha, then it is permissible and valid for both of them to marry each other.

مأخَذُ الفَتوی

کما فی الدر : (وتحل أخت أخيه رضاعا) يصح اتصاله بالمضاف كأن يكون له أخ نسبي له أخت رضاعية، وبالمضاف إليه كأن يكون لأخيه رضاعا أخت نسبا وبهما وهو ظاهر.اھ (3/217)۔
وفي الهداية :و يجوز أن يتزوج ‌الرجل ‌بأخت ‌أخيه من الرضاع " لأنه يجوز أن يتزوج بأخت أخيه من النسب وذلك مثل الأخ من الأب إذا كانت له أخت من أمه جاز لأخيه من أبيه أن يتزوجها "الخ(كتاب الرضاع 2/371/مكتبة رحمانية)۔
