Ruling on the Marriage of Siblings When One Child Has Been Breastfed by Another Woman

Assalamu Alaikum wa Rahmatullahi wa Barakatuh! Respected Mufti Sahib, I would like to ask the following question: Javed Ali and Sajjad Ali are real brothers. Javed Ali has three sons: the eldest (Jawad Ali), the middle one (Fawad Ali), and the youngest (Murad Ali).
Sajjad Ali has two children: a son (Hammad Ali) and a daughter (Jalwa Ali). Hammad Ali, the son of Sajjad Ali, was breastfed by Javed Ali’s wife.
The question is: Can Hammad Ali’s sister, Jalwa Ali, marry any of Javed Ali’s sons? Please explain the ruling in the light of Islamic law.

الجوابُ حامِدا ًو مُصلیِّا ً

It should be noted that due to breastfeeding within the prescribed period of suckling, only the child who was breastfed becomes prohibited (for marriage) to the wet nurse (the woman who breastfed), her ascendants and descendants, and her husband. However, the prohibition does not extend to the other siblings of the breastfed child. Therefore, in the mentioned case, if Miss Jalwa Ali did not drink milk from her aunt (her uncle’s wife) during the nursing period, and likewise, if the son of Javed Ali (whom she intends to marry) did not drink milk from Jalwa Ali’s mother (his aunt), then Jalwa Ali’s marriage to any of her paternal cousins (Javed Ali’s sons) is unquestionably permissible and valid, provided that no other reason of prohibition exists.

کما فی الدر المختار :(وتحل أخت أخيه رضاعا) يصح اتصاله بالمضاف كأن يكون له أخ نسبي له أخت رضاعية، وبالمضاف إليه كأن يكون لأخيه رضاعا أخت نسبا وبهما وهو ظاهر اھ (3/ 217)۔
وفی المبسوط للإمام السرخسي: ولو أن امرأتين لإحداهما بنون وللأخرى بنات فأرضعت التي لها البنات ابنا من بني الأخرى، فإنما تحرم بناتها على ذلك الابن بعينه؛ لأنه صار أخا لهن من الرضاعة، ولا يحرم أحد من بناتها على سائر بني المرأة الأخرى؛ لأنه لم يوجد بينهم الأخوة من الرضاعة حيث لم يجتمعوا على ثدي واحد، ولو كانت المرأة التي لها البنون أرضعت إحدى بنات الأخرى حرمت تلك الابنة على بني المرضعة وغيرها من بناتها يحل على المرضعة، ولو كانت أم البنات أرضعت أحد البنين وأم البنين أرضعت إحدى البنات لم يكن للابن المرتضع من أم البنات أن يتزوج واحدة منهن وكان لإخوته أن يتزوجوا بنات الأخرى إلا الابنة التي أرضعتها أمهم وحدها؛ لأنها أختهم من الرضاعة اھ(30//301)۔
