I have an issue, the details of which are as follows: Hamid is an electrician. Whenever he takes on building work on a contract basis, he purchases all the necessary materials for the job — such as wires, pipe boards, etc. — from Yasir’s shop. Yasir sometimes gives him gifts like pliers, screwdrivers, drill machines, etc. Is it permissible for Hamid to accept such items or not? Also, if a similar case occurred during the time of the Prophet ﷺ, any Companion, or any Imam, please mention it with reference.
The giving and receiving of the mentioned gift, if it is not based on any invalid condition, nor does he engage in any dishonesty such as charging a high price for inexpensive goods or taking the price of high-quality goods while supplying inferior goods, and if such gift exchange already exists between the two parties, then in this case there is no Shar‘i objection to giving it. Otherwise, the full situation should be written down and the Shar‘i ruling sought again.
ففی حاشية ابن عابدين (رد المحتار): حلال من الجانبين كالإهداء للتودد وحرام منهما كالإهداء ليعينه على الظلم اھ (5/ 362)۔
و في حاشية ابن عابدين (رد المحتار): أنه لو أهداه ليعينه عند السلطان بلا شرط لكن يعلم يقينا أنه إنما يهدي ليعينه فمشايخنا على أنه لا بأس به اھ (5/ 373)۔
