Ruling on the Effect of Repeatedly Admitting to Having Given Divorce

What do the respected Muftis say regarding the following matter: The husband said to his wife, “I had given you two divorces at my mother’s house, and one divorce at our home.” This statement was made about two years ago. During this period, on several occasions when disputes arose between them, the husband would repeatedly say, “You have already been freed from me; what are you still doing here?” and would repeat the story of the previous divorces in every quarrel. This is the wife’s sworn statement. Kindly inform us of the Shar‘i ruling in this case: How many divorces have occurred in the mentioned situation? And is it permissible according to Shariah for the two to live together again as husband and wife? Thank you.

الجوابُ حامِدا ًو مُصلیِّا ً

If the wife’s statement is correct and based on truth, without any falsehood, and the husband has admitted in her presence to having given her two divorces at his mother’s house and one divorce at their own home, then three divorces have thereby taken effect upon her, resulting in an irrevocable (mughallazah) prohibition. Reconciliation is now not possible, and they cannot remarry each other without a valid Shar‘i halalah. The woman, after completing her ‘iddah (waiting period), is also free to marry someone else of her choice.

مأخَذُ الفَتوی

قال الله تعالى: {فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ } [البقرة: 230]۔
و في صحيح مسلم: عن عائشة، قالت: جاءت امرأة رفاعة إلى النبي صلى الله عليه وسلم، فقالت: كنت عند رفاعة، فطلقني، فبت طلاقي، فتزوجت عبد الرحمن بن الزبير، وإن ما معه مثل هدبة الثوب، فتبسم رسول الله صلى الله عليه وسلم، فقال: «أتريدين أن ترجعي إلى رفاعة؟ لا، حتى تذوقي عسيلته، ويذوق عسيلتك»، اھ (2/ 1055)۔
و في الفتاوى الهندية: ولو قال لامرأته أنت طالق فقال له رجل ما قلت فقال طلقتها أو قال قلت هي طالق فهي واحدة في القضاء كذا في البدائع اھ (1/ 355)۔
و في بدائع الصنائع: وأما الطلقات الثلاث فحكمها الأصلي هو زوال الملك وزوال حل المحلية أيضا حتى لا يجوز له نكاحها قبل التزوج بزوج آخر لقوله عز وجل { فإن طلقها فلا تحل له من بعد حتى تنكح زوجا غيره } وسواء طلقها ثلاثا متفرقا أو جملة واحدة اھ (3/ 187) والله أعلم بالصواب
