Business of Pan and cigarette shops is Halal or not
Pan and cigarette shops are common in big cities like Lahore, Karachi and Faisalabad. Is this business Halal or Haram? Also, what is the ruling on Tobacco/pan in Islam?
الجوابُ حامِدا ًو مُصلیِّا ً
Purchasing and selling Tobacco is permissible and the income made from selling it is also Halal. As for cigarette smoking, although its usage is allowed due to it not being intoxicant, it leave a bad smell in the mouth and it is also harmful for one’s health, hence one should avoid using it.
مأخَذُ الفَتوی
كما في الدر المختار: و في الأشباه في قاعدة: الأصل الإباحة أو التوقف، ويظهر أثره فيما أشكل حاله كالحيوان المشكل أمره والنبات المجهول سمته اهـ. قلت: فيفهم منه حكم النبات الذي شاع في زماننا المسمى بالتتن فتنبه، وقد كرهه شيخنا العمادي في هديته إلحاقا له بالثوم والبصل بالأولى فتدبر اھ (6/ 460)
و فيه أیضا: والحاصل أن جواز البيع يدور مع حل الانتفاع مجتبى، واعتمده المصنف وسيجيء في المتفرقات اھ. (5/ 69) واللہ اعلم بالصواب
