Giving Charity to a Widow

If a widow earns her own income, is it permissible to give her charity or not?

الجوابُ حامِدا ًو مُصلیِّا ً

In the mentioned case, if the widow owns 7.5 tolas of gold or 52.5 tolas of silver, or a combination of gold, silver, cash, or surplus household items equal in value to that amount of silver, then it is not permissible according to Shariah to give her obligatory charity (such as Zakat, Sadaqat al-Fitr, etc.). However, optional charity (Sadaqah Nafilah)—which carries the same ruling as a gift—can be given to both the wealthy and the poor. Therefore, helping a widow with optional charity is permissible in all cases, even if she earns an income herself.

مأخَذُ الفَتوی

کمافی الشامیة: مصرف الزکاة هو فقیر وهو من له ادنی شئی ای دون نصاب او قدر نصاب غیر نام مستغرق فی الحاجة. (۲/ ۳۳۹)۔۔
وفی العالمگیریة: والافضل فی الزکوة والفطر والنذور الصرف اوّلا الٰی الاخوة والاخوات ثم الٰی اولادهم ثم الٰی الاعمام والعمات ثم الٰی اولادهم ثم الٰی الاخوال والخالات ثم الٰی اولادهم ثم الٰی ذوی الارحام ثم الٰی الجیران ثم الٰی اهل حرفته ثم الٰی اهل معه اور قریته کذا فی السراج الوھاج. (۱/ ۱۹۰)
