My wife had obtained Khula from the court of Karachi, Pakistan. The marriage was done, but the marital relationship was not established. However, we used to live together in love and affection, then we had a fight and I went somewhere during her iddat, we got in touch again during the iddat period and we both wanted to maintain the marriage, but during that time the court issued a Khula decision, now we want to live together again, what is the Sharia solution in such a situation? Is our first marriage still valid or do we have to get married anew? It should be clear that Khula, like other financial contracts, is a contract for which the mutual consent of the parties and a formal offer and acceptance are a condition, which is generally missing in unilateral judicial Khula. Therefore, if the petitioner's wife has actually obtained a degree of unilateral Khula from the court without the permission and consent of the petitioner, while none of the grounds for annulment of the marriage are found, then despite the issuance of this degree, the marriage of the petitioner's wife has not ended according to Sharia law, but rather continues to exist. Therefore, both of them can live as husband and wife without renewing the marriage.
کما فی الدر المختار: (قوله: و شرطه كالطلاق) و هو أهلية الزوج و كون المرأة محلا للطلاق منجزا أو معلقا على الملك و أما ركنه فهو كما في البدائع إذا كان بعوض الإيجاب و القبول لأنه عقد على الطلاق بعوض فلا تقع الفرقة و لا يستحق العوض بدون القبول اھ(3/ 441)۔
وفی المبسوط: (قال) و الخلع جائز عند السلطان و غيره ؛ لأنه عقد يعتمد التراضي كسائر العقود ، و هو بمنزلة الطلاق بعوض ، و للزوج ولاية إيقاع الطلاق ، و لها ولاية التزام العوض ، فلا معنى لاشتراط حضرة السلطان في هذا العقد اھ (6/ 173)۔
