Ruling of a wife who stays separate from her husband

A wife lives separately from her husband without getting a divorce and not availing her expenses from him. What is the ruling with regard to her duties towards her husband? Will the woman be guilty of a sin?

الجوابُ حامِدا ًو مُصلیِّا ً

The questioner did not clarify in the question the reasons and excuses behind her staying separate from her husband, so that the answer be given accordingly. So, if there is no reasonable excuse, then a wife's staying separate from her husband without his permission and consent is not permissible according to Sharia law because it is based on violation of husband's rights. Rather, the woman will be guilty of a sin by neglecting the husband's rights without a Sharia excuse.




مأخَذُ الفَتوی

كما في صحيح البخاري : عن أبي هريرة قال: قال النبي صلى الله عليه وسلم: «إذا ‌باتت ‌المرأة ‌مهاجرة ‌فراش ‌زوجها، لعنتها الملائكة حتى ترجع (باب: إذا باتت المرأة مهاجرة فراش زوجها، ج 7 ، ص 30 ، رقم : 1594، ط : السلطانية)-
وفي صحيح مسلم : عن أبي هريرة ، قال: قال رسول الله صلى الله عليه وسلم: « والذي نفسي بيده، ما من رجل يدعو امرأته إلى فراشها، فتأبى عليه، إلا كان الذي في ‌السماء ‌ساخطا ‌عليها، ‌حتى ‌يرضى ‌عنها (باب تحريم امتناعها من فراش زوجها، ج 4 ، ص 157 ، رقم : 1736، ط : دار الطباعة العامرة، تركيا)-
وفي سنن الترمذي : عن أبيه طلق بن علي قال: قال رسول الله صلى الله عليه وسلم: إذا الرجل دعا ‌زوجته ‌لحاجته ‌فلتأته، ‌وإن ‌كانت ‌على ‌التنور(باب ما جاء في حق الزوج على المرأة، ج 2 ، ص 453 ، رقم : 1160، ط : دار الغرب الإسلامي، بيروت)-
وفي مرقات المفاتيح شرح مشكاة المصابيح : (لعنتها الملائكة) : لأنها كانت مأمورة ‌إلى ‌طاعة ‌زوجها ‌في غير معصية قيل: والحيض ليس بعذر في الامتناع لأن له حقا في الاستمتاع بما فوق الإزار عند الجمهور(باب ما جاء في حق الزوج على المرأة، ج 5 ، ص 2121 ، رقم : 1160، ط : دار الفكر، بيروت)-
وفي رد المحتار: تحت (قوله وسبع لأمة) فعلم من هذا كله أنه لا يحل له وطؤها بما يؤدي إلى إضرارها.(كتاب النكاح، باب القسم بين الزوجات، ج 3، ص 203، ط: سعيد)-
