Ruling on a Job Obtained Through Lying

My question is: if a person presents himself in an institution as holding a degree that he actually does not possess — for example, he has only a 15-year B.Sc. degree but claims to be a “Doctor,” which requires a 17-year degree — in such a case, is his income halal (lawful) and permissible? What does Shariah say about this matter? Should I inform the institution about this issue, as our rights are being violated?

الجوابُ حامِدا ًو مُصلیِّا ً

It should be noted that claiming to possess a degree or certificate that one does not actually have, and then obtaining employment on that basis, falls under the category of lying and deception, which is prohibited and unlawful (haram) in Shariah. Therefore, if a person has obtained employment by presenting a B.Sc. degree as equivalent to a Doctor’s degree, this act will be considered unlawful and haram in Shariah, as it is based on falsehood, fraud, and deception. However, if the person fulfills all the requirements of that job with competence, honesty, and responsibility, then the income earned from that employment will not be considered haram.

مأخَذُ الفَتوی

کما فی سنن أبی داؤد: عن أبي هريرة: أن رسول الله صلى الله عليه وسلم مر برجل يبيع طعاما، فسأله "كيف تبيع؟ " فأخبره، فأوحي إليه: أدخل يدك فيه، فأدخل يده فيه، فإذا هو مبلول، فقال رسول الله صلى الله عليه وسلم: "ليس منا من غش".( باب فی النھی عن الغش، ج:5، ص:323، ناشر: دار الرسالۃ العالمیۃ )-
و فی الشامیۃ : قولہ ( لأن الغش حرام ) ( إلی قولہ ) قال بعض مشایخنا یفسق و ترد شھادتہ إلخ (‌‌[مطلب في جملة ما يسقط به الخيار،ج: 5 ص: 47، ناشر: سعید )-
و فی الدر المختار: أفاد أن ركنها الإيجاب والقبول. وشرطها كون الأجرة والمنفعة معلومتين؛ لأن جهالتهما تفضي إلى المنازعة اھ
و فی رد المحتار تحت: (قوله كون الأجرة والمنفعة معلومتين) أما الأول فكقوله بكذا دراهم أو دنانير وينصرف إلى غالب نقد البلد، فلو الغلبة مختلفة فسدت الإجارة ما لم يبين نقدا منها فلو كانت كيليا أو وزنيا أو عدديا متقاربا فالشرط بيان القدر والصفة وكذا مكان الإيفاء لو له حمل ومؤنة عنده، وإلا فلا يحتاج إليه كبيان الأجل، ولو كانت ثيابا أو عروضا فالشرط بيان الأجل والقدر والصفة لو غير مشار إليها، ولو كانت حيوانا فلا يجوز إلا أن يكون معينا بحر ملخصا. وأما الثاني فيأتي في المتن قريبا (قوله ساعة فساعة) ؛ ‌لأن ‌المنفعة ‌عرض لا تبقى زمانين، فإذا كان حدوثه كذلك فيملك بدله كذلك قصدا للتعادل، اھ ( شروط الإجارۃ، ج:6، ص:5، ناشر: سعید )-
