What do the esteemed scholars and respected Muftis say regarding the following matter that in 2006, I gave a loan of 200,000 rupees to my friend, without setting any specific time for repayment. In the meantime, I kept asking him to return my money, but he was unable to do so due to financial constraints.
Now, his business has grown, and he wants to repay my loan. In doing so, he is offering me 350,000 rupees instead of the original 200,000.
Is it permissible for me to take 350,000 rupees in return for the 200,000 loan, especially when he is giving the extra amount willingly and happily?
It should be clear that lending 200,000 rupees and then taking an additional 150,000 rupees, whether as a condition or based on customary practice, constitutes clear interest (riba), which must be strictly avoided.
However, after the repayment of the original loan of 200,000 rupees, if the borrower, without any demand or expectation, willingly chooses to give some extra amount as a gift, then there is no Shariah objection in accepting it.
كما في الفتاوى الهندية: وهو في الشرع عبارة عن فضل مال لا يقابله عوض في معاوضة مال بمال وهو محرم في كل مكيل وموزون بيع مع جنسه (إلی قوله) وما يباع بالأواقي بجنسه مثلا بمثل صح وإن تفاضل أحدهما لا يصح وجيده ورديئه سواء حتى لا يصح بيع الجيد بالرديء مما فيه الربا إلا مثلا بمثل اھ (3/ 117)۔
وفي حاشية ابن عابدين: (قوله كل قرض جر نفعا حرام) أي إذا كان مشروطا كما علم مما نقله عن البحر، وعن الخلاصة وفي الذخيرة وإن لم يكن النفع مشروطا في القرض، فعلى قول الكرخي لا بأس به اھ (5/ 166)۔
