Ruling on Stipulating a Condition of Non-Sale in a Gift

What do the esteemed scholars and honorable Muftis say regarding a person who gifted me some books and, at the same time, stated that selling them is prohibited. Now, due to necessity, am I allowed to exchange or sell them, or not? Please explain and may you be rewarded.

الجوابُ حامِدا ًو مُصلیِّا ً

The mentioned gift (hibah) is valid, and the condition of not selling it is invalid. Therefore, in case of necessity, the book may be exchanged or sold to fulfill one’s need.

مأخَذُ الفَتوی

کمافی الھدایۃ: قال: "فإن وهبها له على أن يردها عليه أو على أن يعتقها أو أن يتخذها أم ولد أو وهب دارا أو تصدق عليه بدار على أن يرد عليه شيئا منها أو يعوضه شيئا منها فالهبة جائزة والشرط باطل". لأن هذه الشروط تخالف مقتضى العقد فكانت فاسدة، والهبة لا تبطل بها اھ(3/228)۔
