Working a Job Other Than the One Specified on the Visa and Paying Fees

Assalamu Alaikum! My visa in Saudi Arabia is for working as a driver, but I do sewing work. Upon release, the Kafeel (sponsor) charges 300–400 riyals per month, and the government also takes a fee. Is it permissible to do sewing work, and is earning from it permissible?

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clarified that when a person goes to another country, it is obligatory upon them to abide by the lawful regulations of that country. Therefore, in the present case, if the person holds a visa for driving, it is not Shariʿah-wise permissible for them to take up any work other than driving. If they do so, it falls under the category of deceit and violation of the contract according to Shariʿah. However, this does not render the income earned from such work impermissible (haram).

مأخَذُ الفَتوی

کما فی الصحیح للبخاری: عن عبد اللہ عن النبی ﷺ قال إن الصدق یھدی إلی البر و إن البر یھدی إلی الجنۃ و إن الرجل لیصدق حتی یکون صدیقا و إن الکذب یھدی إلی الفجور، و إن الفجور یھدی إلی النار و إن الرجل لیکذب حتی یکتب عند اللہ کذابا (باب قول اللہ تعالی(( اتقوا اللہ و کونو مع الصٰدقین )) و ما ینھی عن الکذب، ج 4، ص 2712، ط: بشری)۔
و فی الدر المختار: (افترض عليه إجابته) لأن طاعة الإمام فيما ليس بمعصية فرض فكيف فيما هو طاعة بدائع (لو قادرا) الخ
وفی الشامیۃ تحت: (قوله: افترض عليه إجابته) والأصل فيه قوله تعالى {وأولي الأمر منكم}(الی قولہ) «عليكم بالسمع والطاعة لكل من يؤمر عليكم ما لم يأمركم بمنكر» ففي المنكر لا سمع ولا طاعة الخ (باب البغاۃ،ج 4،ص 265،ط:سعید)۔
