Ruling on Earning Income by Paying a Registration Fee to View Advertisements

Assalamu Alaikum wa Rahmatullahi wa Barakatuh! I am participating in an online activity in which I was initially required to invest Tk. 2,520. After that, I am allowed to watch 5 advertisements daily, and for each advertisement I watch I am paid Tk. 18, i.e., Tk. 90 per day. I was told this scheme will continue for a full year. When I withdraw profits, a portion is deducted from me as fees or charges. I have a doubt whether this income is permissible (halal) or impermissible (haram) according to Islamic Shariʿah. Therefore kindly answer the following questions in detail: (1) Is this income halal or haram? (2) Does the profit being paid on the invested capital fall into the category of interest (riba)? (3) What conditions would be necessary for this scheme to be permissible (halal)?

الجوابُ حامِدا ًو مُصلیِّا ً

The business the questioner is asking about has become very common nowadays. In such schemes, the company’s main activity— for which it invites people to become members— is earning money by watching advertisements (whether the membership is based on investment or network marketing). From a Shariʿah perspective, several problematic issues exist in this type of business:
1. Watching ads is not a valid item of contract (aqd) in Shariʿah that can be used as the basis for hiring (ijarah), nor can a member be considered deserving of wages merely for watching ads.
2. Many advertisements contain impermissible (non-Shariʿah-compliant) content.
3. The number of viewers is artificially increased, which falls under deception and fraud.
4. The problem becomes even more severe when network marketing is also involved in such a scheme.
Therefore, becoming a member of such a company or inviting others to become members is not permissible, and one must refrain from it.

مأخَذُ الفَتوی

کما فی سنن الترمذی : عن أبی هريرة أن رسول الله ﷺ مر على صبرة من طعام، فأدخل يده فيها، فنالت أصابعه بللا فقال: يا صاحب الطعام، ما هذا ؟ قال: أصابته السماء يا رسول الله قال: أفلا جعلته فوق الطعام حتى يراه الناس ثم قال: من غش فليس منا الخ (کتاب الایمان ، ج: 1 ، ص: 70 ، ط: سعید)ـ
و فی بدائع الصنائع : (و منها) : أن يكون الربح جزأ شائعا فی الجملة، لا معينا، فإن عينا عشرة، أو مائةً، أو نحو ذلك كانت الشركة فاسدة؛ لأن العقد يقتضی تحقق الشركة فی الربح و التعيين يقطع الشركة لجواز أن لا يحصل من الربح إلا القدر المعين لأحدهما، فلا يتحقق الشرکۃ فی الربح الخ (كتاب الشركة، ج: 6 ،ص: 59 ، ط: ایچ-ایم-سعید)ـ۔
و فی الدر المختار : (و كون الربح بينهما شائعا) فلو عين قدرا فسدت الخ (کتاب المضاربة ، ج: 5 ، ص: 648 ، ط: ایچ-ایم-سعید)۔
وفي الدر المختار: (هي) لغة: اسم للأجرة وهو ما يستحق على عمل الخير ولذا يدعى به، يقال أعظم الله أجرك. وشرعا (تمليك نفع) مقصود من العين (بعوض) حتى لو استأجر ثيابا أو أواني ليتجمل بها أو دابة ليجنبها بين يديه أو دارا لا ليسكنها أو عبدا أو دراهم أو غير ذلك لا ليستعمله بل ليظن الناس أنه له فالإجارة فاسدة في الكل، ولا أجر له لأنها منفعة غير مقصودة من العين بزازية وسيجيء اھ
و في رد المحتار : تحت : (قوله مقصود من العين) أي في الشرع ونظر العقلاء، بخلاف ما سيذكره فإنه وإن كان مقصودا للمستأجر لكنه لا نفع فيه وليس من المقاصد الشرعية، وشمل ما يقصد ولو لغيره لما سيأتي عن البحر من جواز استئجار الأرض مقيلا ومراحا، فإن مقصوده الاستئجار للزراعة مثلا، ويذكر ذلك حيلة للزومها إذا لم يمكن زرعها تأمل اھ (کتاب الاجارۃ ، ج: 6 ، ص: 4 ، ط: سعید)ـ
