Ruling on Performing Zuhr Prayer Instead of Jumʿah in a Non-Muslim Country

Assalamu Alaikum, and good morning. My name is Farukh Hassan, and, Alhamdulillah, I am a Muslim. I am currently facing a situation in which I require guidance according to Islamic teachings and rulings. I live in a non-Muslim country, and my workplace is in a small village located approximately 40–45 kilometers away from a large city. In that large city, there is a mosque where Jumʿah (Friday) prayer is offered. However, in the village where I work, there is neither a mosque nor any Muslims—everyone in the village is non-Muslim. In this situation, am I permitted to perform the Zuhr prayer instead of Jumʿah prayer? This is because my employer or the institution does not allow or make it possible for me to travel for one hour to the city for Jumʿah and then return for another hour. In such a scenario, is it permissible to perform Zuhr prayer in place of Jumʿah prayer? Kindly provide guidance. Thank you.

الجوابُ حامِدا ًو مُصلیِّا ً

If the place where the questioner is employed is not located in a city or its suburban area (i.e., areas associated with the city, such as the city’s Eidgah, cemetery, etc.), but rather in a village far from any urban settlement, then Jumʿah prayer is not obligatory for the questioner. Instead, it is obligatory for him to perform the Zuhr prayer.

مأخَذُ الفَتوی

کما فی البدائع : وكذا لا يصح أداء الجمعة إلا في المصر وتوابعه فلا تجب على أهل القرى التي ليست من توابع المصر ولا يصح أداء الجمعة فيها (باب الجمعۃ ، ج: ١،ص: ٢٥٩ ، مط: سعيد)
وفي الدر المختار : ( ويشترط لصحتها ) سبعة أشياء الأول ( المصر وهو ما لا يسع أكبر مساجده أهله المكلفين بها ) وعليه فتوى أكثر الفقهاء الى قوله( أو فناؤه ) بكسر الفاء ( وهو ما ) حوله ( اتصل به ) أولا كما حرره ابن الكمال وغيره
وفي الشامية تحت قوله (كما حرره ابن الكمال) فقد نص الأئمة على أن الفناء ما أعد لدفن الموتى وحوائج المصر كركض الخيل والدواب وجمع العساكر والخروج للرمي وغير ذلك (باب الجمعة ،ج:٢ ص: ١٣٩،مط: سيعد)
وفي الهندية : ومن لا تجب عليهم الجمعة من أهل القرى والبوادي لهم أن يصلوا الظهر بجماعة يوم الجمعة بأذان وإقامة (الباب السادس في الجمعة،ج:١، ص: ١٤٥،مط : ماجدية)
و فی الھدایۃ : لا تصح الجمعة إلا في مصر جامع أو في مصلى المصر ولا تجوز في القرى لقوله عليه الصلاة والسلام لا جمعة ولا تشريق ولا فطر ولا أضحى إلا في مصر جامع( باب صلوۃ الجمعۃ ،ج: 1،ص: 168،ناشر: مجیدیہ)
