“What do the respected Islamic scholars say regarding the following matter?
I am 60/62 years old, married, and my son is disobedient. Influenced by his wife’s words, he even beats me and also beats his sister. He abuses his mother verbally. I and the other members of the household are extremely troubled because of him.
According to Islamic law, am I allowed to remove him from the house? Can I disinherit him from my property? Since we fear harm from him, can I hand him over to the police? Please provide the ruling according to Shariah.”
“If the details mentioned by the questioner are correct and based on facts, then in such a situation the son of the questioner has committed a serious sin by physically abusing and verbally insulting his parents and sister. It is therefore religiously obligatory upon him to immediately repent, seek forgiveness from Allah, and apologize to his parents and sister.
However, if the son does not refrain from such actions and continues to cause harm and distress to his parents, then since the son is an adult, sane, and married, his father is no longer obligated to provide for his maintenance and accommodation. Therefore, the father may separate him from the household.
However, the father does not have the authority to deprive him of his inheritance or declare him disinherited, because inheritance rights are determined by Islamic law, and Allah has assigned the shares of each heir.
As for handing the son over to the police, it would be better for the questioner to explain the complete circumstances to the relevant authorities or responsible people and seek their guidance regarding this matter.”
كما في رد المحتار: (قوله الفقير) أي إن لم يبلغ حد الكسب، فإن بلغه كان للأب أن يؤجره أو يدفعه في حرفة ليكتسب وينفق عليه من كسبه لو كان ذكرا، بخلاف الأنثى (باب النفقة، ج: 3، ص: 612، ط: ايج ايم سعيد)
وفي الخانية: نفقة الأولاد الصغار والإناث المعسرات على الأب لا يشاركه في ذلك أحد ولا تسقط بفقره ولا يجب عليه نفقة الذكور البكار إلا أن يكون الولد عاجزا عن الكسب لزمانة أو مرض فتكون نفقته على والده (الهندية، ج: 1، ص: 445)
وفي مجمع الأنهر: (ولا غيبة لظالم) يؤذي الناس بقوله وفعله (إلى قوله) (ولا إثم في السعي به) أي بالظالم إلى السلطان ليزجره لأنه من باب النهي عن المنكر ومنع الظلم.اهـ (كتاب الكراهية، فصل في المتفرقات، ج: 2، ص: 552-556، ط: دار إحياء التراث العربي، بيروت)
وفي العقود الدرية في تنقيح الفتاوى الحامدية: الإرث جبري لا يسقط بالإسقاط.إلخ (كتاب الدعوى، ج: 2، ص: 26، ط: دار المعرفة)
وفي الهندية: رجل له أولاد فأقر بجميع ضياعه لولد فإنه يأثم فلو أبطل قاض إقراره إن أبطل بتأويل معتبر في الشرع وهو فقيه يجوز وإلا فلا هكذا ذكر وهذا إذا كان أولاده كلهم صلحاء أما إذا كان بعضهم فاسقا فأقر بجميع ماله للصالح فلا يأثم كذا في جواهر الفتاوى.اهـ (كتاب الكراهية، الباب الثلاثون في المتفرقات، ج: 5، ص: 381، ط: مكتبة ماجدية)
