The Procedure of Renewing the Marriage Contract

Assalamu Alaikum wa Rahmatullah! Respected Sir, I would like to ask a question regarding a matter. Due to certain reasons, I wish to renew my Nikah (Tajdeed-e-Nikah). However, due to the lack of religious understanding in our area, people do not comprehend this issue properly. My wife may also not easily understand the matter right away. There is also a concern that people might raise unnecessary objections or create an uproar over it later. Can you please suggest a simple and brief method for renewing Nikah in such a situation? Secondly, is it necessary to explain the reason for renewing the Nikah to one’s wife—whether the reason involves an issue of separation (ba’in) or something else? Also, can my father and my wife's brother serve as witnesses for the renewal of Nikah? Thank you.

الجوابُ حامِدا ًو مُصلیِّا ً

If neither the questioner nor his wife has committed any act or statement that affects the validity of the marriage, then there is no need to renew the Nikah. However, if due to any such statement or action it becomes necessary to renew the Nikah, then the questioner should perform the renewal of Nikah by making an offer and acceptance (Ijab-o-Qubool) in the presence of two male witnesses, or one male and two female witnesses. Therefore, if the questioner's biological brother and father are present as witnesses, and the questioner performs Ijab-o-Qubool in their presence, the Nikah will be validly renewed.

مأخَذُ الفَتوی

كما في حاشية ابن عابدين: (قوله وأولاده أولاد زنا) كذا في فصول العمادي، لكن ذكر في [نور العين] ويجدد بينهما النكاح إن رضيت زوجته بالعود إليه وإلا فلا تجبر، والمولود بينهما قبل تجديد النكاح بالوطء بعد الردة يثبت نسبه منه لكن يكون زنا اهـ (4/ 247)۔
و في الفتاوى الهندية: وينعقد بحضور من لا تقبل شهادته له أصلا كما إذا تزوج امرأة بشهادة ابنيه منها وكذا إذا تزوج بشهادة ابنيه لا منها أو ابنيها لا منه هكذا في البدائع والأصل في هذا الباب أن كل من يصلح أن يكون وليا في النكاح بولاية نفسه صلح أن يكون شاهدا ومن لا فلا كذا في الخلاصة ويشترط العدد فلا ينعقد النكاح بشاهد واحد هكذا في البدائع ولا يشترط وصف الذكورة حتى ينعقد بحضور رجل وامرأتين كذا في الهداية اھ (1/ 267)۔
