Is Marriage Permissible with the Maternal Uncle’s Daughter After Having Drunk the Grandmother’s Milk in Childhood?

What do the honorable Muftis say regarding this issue: My name is Ehtisham. In my childhood, I drank the milk of my real maternal grandmother along with my youngest real maternal uncle. Now, my family wishes to arrange my marriage with the daughter of my eldest real maternal uncle. Respected Mufti, I would like to ask: Is this marriage permissible for me or not?

الجوابُ حامِدا ًو مُصلیِّا ً

Since the questioner drank his grandmother’s milk during the nursing period, he became her foster son, and thus the foster brother of all his uncles (both younger and elder). Consequently, he is regarded as a foster uncle to their children. Just as it is impermissible for a paternal uncle to marry his biological niece, it is likewise impermissible for a foster uncle to marry his foster niece. Therefore, in the mentioned case, Ehtisham’s marriage with the daughter of his elder maternal uncle is not permissible, and such a marriage must be avoided.

كما قال الله تعالى: {حُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْ وَأَخَوَاتُكُمْ وَعَمَّاتُكُمْ وَخَالَاتُكُمْ وَبَنَاتُ الْأَخِ وَبَنَاتُ الْأُخْتِ وَأُمَّهَاتُكُمُ اللَّاتِي أَرْضَعْنَكُمْ وَأَخَوَاتُكُمْ مِنَ الرَّضَاعَةِ وَأُمَّهَاتُ نِسَائِكُمْ وَرَبَائِبُكُمُ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلَا جُنَاحَ عَلَيْكُمْ وَحَلَائِلُ أَبْنَائِكُمُ الَّذِينَ مِنْ أَصْلَابِكُمْ وَأَنْ تَجْمَعُوا بَيْنَ الْأُخْتَيْنِ إِلَّا مَا قَدْ سَلَفَ إِنَّ اللَّهَ كَانَ غَفُورًا رَحِيمًا } [النساء: 23]۔
و في بدائع الصنائع في ترتيب الشرائع: وقد قال الله عز وجل {وأخواتكم من الرضاعة} [النساء: 23] أثبت الله تعالى الأخوة بين بنات المرضعة وبين المرضع والحرمة بينهما مطلقا من غير فصل بين أخت وأخت، وكذا بنات بناتها وبنات أبنائها وإن سفلن؛ لأنهن بنات أخ المرضع وأخته من الرضاعة، وهن يحرمن من النسب كذا من الرضاعة. (4/ 2) والله اعلم بالصواب
