In Which Currency Should a Loan Be Repaid: Rupees or Riyals?

I took a loan from an elder in Pakistani Rupees in 2020. He sent me the money from Saudi Arabia and recorded the amount in Saudi Riyals, which I was not aware of. According to me, the loan was in Pakistani currency. My question is: Should I repay in Pakistani Rupees or, according to his written record, in Saudi Riyals? He has now passed away. Please guide me. Thank you.

الجوابُ حامِدا ًو مُصلیِّا ً

It is clear that when a loan is taken in a specific currency, then it is obligatory upon the borrower to repay the loan in that same currency. Therefore, in the mentioned case, if the elder converted the Riyals into Pakistani currency and the borrower actually received the loan in Pakistani Rupees, then the borrower is required to repay the loan in Pakistani Rupees only.

مأخَذُ الفَتوی

کما فی الدر المختار: (هو) لغة: ما تعطيه لتتقاضاه، وشرعا: ما تعطيه من مثلي لتتقاضاه وهو أخصر من قوله (عقد مخصوص) أي بلفظ القرض ونحوه (يرد على دفع مال) بمنزلة الجنس (مثلي) خرج القيمي (لآخر ليرد مثله) خرج نحو وديعة وهبة الخ ( فصل فی القرض، ج 5، ص 161،ط: سعید)۔
وفی رد المحتار: وإن استقرض دانق فلوس أو نصف درهم فلوس، ثم رخصت أو غلت لم يكن عليه إلا مثل عدد الذي أخذه الخ ( فصل فی القرض، ج 5، ص 162،ط: سعید)۔
وفیہ ایضاً:: الديون تقضى بأمثالها الخ (مطلب في قبول قوله دفعت المال،ج 4، ص 320، ط: سعید)۔
وفی تنقيح الحامدية:رجل استقرض من آخر مبلغا من الدراهم وتصرف بها ثم غلاا سعرهافهل عليه ردمثلها؟ نعم ولا ينظر الى غلاء الدراهم ورخصها الخ ۔(باب القرض ،ج 1، ص 294 ط: حقانية)۔
