After donning the Ihram, He was stopped at the airport

If someone has made intention for Umra, enters the state of Ihram, then has been stopped at the airport and sent back home because of Corona, does he have to give Dam (دم: a means of atonement for not completing any of the elements of Hajj)? And would he/she come out of the state of Ihram? Please inform us through the light of the Shari’ah.

الجوابُ حامِدا ًو مُصلیِّا ً

With regards to the inquired about situation, it is necessary for those who recited the Talbiya for performing Umra after donning the Ihram, and was then stopped at the airport and sent home because of the Corona Virus due to which it wasn’t possible for them to complete their Umra to come out of the state of Ihram. They, or someone on their behalf, must slaughter an animal as Dam within the boundaries of the Haram. After this animal will be slaughtered, they will be free from the restrictions of being in the state of Ihram and they will once again become “Halal” (i.e. one who is not in the state of Ihram). However, after they exit the state of Ihram, they will also have to do Qaza of their Umra.

مأخَذُ الفَتوی

ففی الدر المختار: (إذا أحصر بعدو أو مرض) أو موت محرم أو هلاك نفقة حل له التحلل فحينئذ (بعث المفرد دما) أو قيمته فإن لم يجد بقي محرما حين يجد أو يتحلل بطواف (إلی قوله) (و) يجب (عليه إن حل من حجه) ولو نفلا (حجة) بالشروع (وعمرة) للتحلل إن لم يحج من عامه (وعلى المعتمر عمرة، و) على (القارن حجة وعمرتان) إحداهما للتحلل اھ (2/ 591-593)
وفي حاشية ابن عابدين: (قوله بعث المفرد) أي بالحج أو العمرة إلى الحرم قهستاني اھ (2/ 591)
وفى بدائع الصنائع: وإن كان إحرامه بالعمرة لا غير قضاها لوجوبها بالشروع في أي وقت شاء؛ لأنه ليس لها وقت معين. اھ (2/ 182)
كما في الدر المختار: (وإذا لبى ناويا) نسكا (أو ساق الهدي أو قلد) أي ربط قلادة على عنق (بدنة نفل أو جزاء صيد) قتله في الحرم أو في إحرام سابق (ونحوه) كجناية ونذر ومتعة وقران (وتوجه معها) والحال أنه (يريد الحج) وهل العمرة كذلك ينبغي؟ نعم (أو بعثها ثم توجه ولحقها) قبل الميقات، فلو بعده لزمه الإحرام بالتلبية من الميقات (أو بعثها لمتعة) أو لقران وكان التقليد والتوجه (في أشهره) وإلا لم يصر محرما حتى يلحقها (وتوجه بنية الإحرام وإن لم يلحقها) استحسانا (فقد أحرم) اھ (2/ 485)
