Receiving Wages by a Business Partner for Performing Additional Work

We have started a business in partnership, with a profit and investment ratio of 60% and 40%. Since I personally manage the shop (business) and work there all seven days of the week, am I entitled to receive wages for my work? What is the Shari‘ah ruling regarding this?

الجوابُ حامِدا ًو مُصلیِّا ً

If the inquirer works more than his partner, he may allocate a greater share of the profit for himself in proportion to his additional work.

مأخَذُ الفَتوی

ففي الدر المختار: (و) لذا (تصح) عاما وخاصا ومطلقا ومؤقتا و (مع التفاضل في المال دون الربح وعكس اھ (4/ 311)۔
و في حاشية ابن عابدين: (قوله: ومع التفاضل في المال دون الربح) أي بأن يكون لأحدهما ألف وللآخر ألفان مثلا واشترطا التساوي في الربح، وقوله وعكسه: أي بأن يتساوى المالان ويتفاضلا في الربح، لكن هذا مقيد بأن يشترط الأكثر للعامل منهما أو لأكثرها عملا، أما لو شرطاه للقاعد أو لأقلهما عملا فلا يجوز كما في البحر عن الزيلعي والكمال. قلت: والظاهر أن هذا محمول على ما إذا كان العمل مشروطا على أحدهما. اھ (4/ 312)۔
