Divorce

The husband wrote divorce in writing and gave it to the wife's family. The family saw the divorce certificate, but the girl herself did not see it, nor did she hear the words of divorce. Now after three years, the two wish to live together again. Is their marriage still intact?

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clear that for the purpose of divorce, it is not necessary for the wife to hear the words of divorce with her own ears or see the written divorce (if written on divorce form), but even without it, divorce takes place. When the husband has given to the referred woman three Talaq in written form, the three Talaq have been occurred and irrevocable separation has been established against her. Now, there can be no retrieve, and no remarriage can take place between them without Shar’i Halala. However the questioner is free to marry in any other place after the completion of her period of Iddat.

کمافی رد المحتارعلى الدرالمختار:
"وقوله:(ركنه لفظ مخصوص) هو ما جعل دلالة على معنى الطلاق من صريح أو كناية (الی قولہ) وبه ظهر أن من تشاجر مع زوجته، فأعطاها ثلاثة أحجار ينوي الطلاق ولم يذكر لفظًا لا صريحًا ولا كنايةً لايقع عليه."(3/230 ط: سعيد) واللہ اعلم
