Assalamu Alaikum Wa Rahmathullahi Wa Barakathuhu!
What do the learned Muftis say about this matter that my marriage (named so and so) took place with (named so and so) from which we have two children, my husband used to take drugs etc., so I got (khula) divorce from the court in 2021, which did not include the husband's consent, now we want to be together again, so Please guide me whether it is right for us to live together after three years or not. Whereas my husband never gave any verbal divorce.

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clear that, Khula is a contract like other financial contracts, which requires the mutual consent of the parties to be correct and valid. So if the questioner’s husband or a lawyer appointed by him did not appear in the court and express their consent to this divorce, the contract of marriage does not terminate as per the Shari’a even though the court issued the degree of divorce, but it remains intact as it was. And now if the husband and wife want to live together, then it is lawful and correct for them to live together as they were, as husband and wife even without renewing the marriage.

مأخَذُ الفَتوی

کما فی احکام القرآن للجصاص: قال أصحابنا: إنهما لا يجوز خلعهما إلا برضى الزوجين, فقال أصحابنا: ليس للحكمين أن يفرقا إلا برضى الزوجين; لأن الحاكم لا يملك ذلك فكيف يملكه الحكمان؟ وإنما الحكمان وكيلان لهما أحدهما وكيل المرأة والآخر وكيل الزوج في الخلع(الی قولہ) وكيف يجوز للحكمين أن يخلعا بغير رضاه ويخرجا المال عن ملكها الخ ( ج2 ص 239 مطلب البیان من اللہ تعالی علی وجہین ط العلمیہ)
وفی بدائع الصنائع: وأما رکنہ فھو الإیجاب والقبول لأنہ عقد علی الطلاق بعوض فلا تقع الفرقۃ، ولا یستحق العوض بدون القبول الخ (کتاب الطلاق فصل فی رکن الطلاق ج 3 صـ 145 ط: دار الکتب العلمیۃ)
