What do the learned Muftis say in the following matter: I, Muhammad Akram Khan, pronounced the words of divorce “Talaq, Talaq, Talaq” three times to my wife, Shaheen Parveen, during a domestic dispute and in a state of anger, and had also been under the influence of intoxication since night. Now we need to know how many divorces occurred in this case and what is the ruling for us now?
It should be known that even if a person is intoxicated, the divorce given by him becomes valid under the light of Sharia. Therefore, when the questioner, in a state of anger and quarrel, utterd the aforementioned words "divorce, divorce, divorce," to his wife, the questioner's wife has been declared to be in a state of absolute prohibition (Hurmat e Mughazhzhala), which cannot be revocable, and they cannot marry each other without the process of Halala in Shar’ia. Therefore, it is obligatory for both of them to immediately separate from each other and never to establish marital relations, otherwise both of them will be guilty of grave sins. However, after completing the waiting period of Iddath, the woman will be free to marry in another place of her own free will.
کما في الهندية : إذا قال لامرأته أنت طالق وطالق وطالق ولم يعلقه بالشرط ان كانت مدخولة طلقت ثلاثا وان كانت غير مد خولة طلقت واحدة الخ (ج1،ص 355، ط:ماجدیۃ)۔
وفي الهداية : وإن كان الطلاق ثلاثا فى الحرة ،أو ثنتين في الأمة لم تحل له حتى تنكح زوجا غيره نكاحاً صحيحاً ويدخل بها ثم يطلقها أو يموت عنها الخ (ج۲ ص ۹۲ ط: انعامية)۔
وفی رد المحتار: ویقع الطلاق من غضب خلافاً لابن القیم اھ وھذا الموافق عندنا لما مر فی المدھوش الخ (ج3، ص244، ط:سعید)۔
و فی الھندیۃ: و طلاق السكران واقع إذا سكر من الخمر أو النبيذ. و هو مذهب أصحابنا رحمهم الله تعالى كذا في المحيط۔(کتاب الطلاق، فصل فیمن یقع طلاقہ و فیمن لا یقع طلاقہ ج۔ ۱ ص۔ ۳۵۳ ط۔ ماجدیہ)-
