Respected Mufti Sahib, Assalamu Alaikum!
I had a dispute with my wife, during which I also slapped her two or three times. She said to me, "Divorce me," and in response I said: "I divorce you, divorce, divorce, I divorce you; you are free from me." We have two daughters — one is four years old and the younger one is one year old. Kindly, if there is any possible solution to this issue, I humbly request you to inform me.
In the given case, when the husband pronounced three divorces to his wife using the stated emphatic words, three divorces (talaq) have taken effect, and an irrevocable separation (hurmat-e-mughallazah) has been established. Therefore, reconciliation (ruju) is no longer permissible, and without a valid Sharʿi ḥalalah, they cannot remarry. It is now obligatory for both to separate from each other. After completing her ʿiddah (waiting period), the woman is religiously free to marry another Muslim man.
کما قال اللہ تعالیٰ: {فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ } [البقرة: 230] .
و في الفتاوى الهندية: وإن كان الطلاق ثلاثا في الحرة وثنتين في الأمة لم تحل له حتى ۔تنكح زوجا غيره نكاحا صحيحا ويدخل بها ثم يطلقها أو يموت عنها كذا في الهداية اھ (1/ 473)۔
و في الدر المختار: كرر لفظ الطلاق وقع الكل، وإن نوى التأكيد دين اھ (3/ 293)۔
و في حاشية ابن عابدين: (قوله وإن نوى التأكيد دين) أي ووقع الكل قضاء، وكذا إذا طلق أشباه: أي بأن لم ينو استئنافا ولا تأكيدا لأن الأصل عدم التأكيد اھ (3/ 293)۔
