My husband signed the divorce papers under severe pressure from his mother and first wife. Is there any scope for reconciliation?
If the questioner’s husband has signed the divorce certificate containing three Talaq (even though he did so under the pressure of his mother and first wife), then the three Talaq contained in this divorce certificate have been occurred and irrevocable separation has been established against her. There can be no retrieve, and no remarriage can take place between them without Shar’i Halala. However the questioner is free to marry in any other place after the completion of her period of Iddat.
قال اللہ تعالیٰ: ﴿فإن طلقہا فلا تحل لہ من بعد حتی تنکح زوجًا غیرہ﴾ (البقرۃ:۲۳۰)۔
و في الدر المختار للعلامة الحصكفى: کتب الطلاق ان مستبینا علی نحو لوح وقع إن نوی وقیل مطلقًا الخ وفي الفتاوی الشامیة: تحت(قولہ کتب الطلاق الخ) (إلى قوله) وإن کانت مرسومۃ یقع الطلاق نوی اولم ینو الخ (ج۳، ص۲۴۶)۔
