Divorcing a woman during her monthly periods

Divorcing a woman during her monthly periods

Will divorcing a wife during her menstrual period establishes a divorce? If he has intercourse after her monthly period ends and divorces her, will it constitute a divorce? If the wife is not in her monthly periods and has not had intercourse and the husband divorces her, will it constitute a divorce?

الجوابُ حامِدا ًو مُصلیِّا ً

In the three situations mentioned in the question, divorce will occur according to Sharia law. However, it is forbidden according to Sharia to divorce during menstruation or during the period of purity during which sexual intercourse took place, but divorce will occur in any case.

كما في سنن الترمذي : عن أبي هريرة قال: قال رسول الله صلى الله عليه وسلم: " ثلاث جدهن جد، وهزلهن جد: النكاح، والطلاق، والرجعة(‌‌باب ما جاء في الجد والهزل في الطلاق، ج 3، ص 482، رقم : 1184، مطبعة مصطفى، مصر)-

وفي الفتاوى الهندية : (والبدعي) من حيث الوقت أن يطلق المدخول بها وهي من ذوات الأقراء في حالة الحيض أو في طهر جامعها فيه وكان الطلاق واقعا الخ (كتاب الطلاق، ‌الطلاق ‌البدعي، ج 1، ص 349، ط : دار الفكر، بيروت)-
