charging excess amount than the market price in installments

Is it permissible to buy a motorcycle on installments Shop from CSD (Servicemen's)? Remember that in CSD, an additional amount of ten thousand is taken from the market.

الجوابُ حامِدا ًو مُصلیِّا ً

In the case of buying and selling on installments, it is undoubtedly permissible and correct to charge some additional amount from the market price, whether it is from CSD or from someone else, whether it is a motorcycle or any other thing, with following few conditions.
First, the issue of sale by cash or installments should be decided at the time of the contract.
After stating the total price, the total installments and the amount of each installment should also be determined.
And if for some reason, if there is a delay in the payment of the installment, no penalty should be charged. Buying and selling on installments without in keeping the above conditions, is not permissible according to Sharia and on the contrary, it is necessary to avoid it.

مأخَذُ الفَتوی

ففي المبسوط للسرخسي: وإذا عقد العقد على أنه إلى أجل كذا بكذا وبالنقد بكذا أو قال إلى شهر بكذا أو إلى شهرين بكذا فهو فاسد لأنه لم يعاطه على ثمن معلوم ولنهي النبي صلى الله عليه وسلم عن شرطين في بيع وهذا هو تفسير الشرطين في بيع ومطلق النهي يوجب الفساد في العقود الشرعية وهذا إذا افترقا على هذا فإن كان يتراضيان بينهما ولم يتفرقا حتى قاطعه على ثمن معلوم وأتما العقد عليه فهو جائز لأنهما ما افترقا إلا بعد تمام شرط صحة العقد اھ (13/ 13)۔
وفي حاشية ابن عابدين: وعن أبي يوسف يجوز التعزير للسلطان بأخذ المال. وعندهما وباقي الأئمة لا يجوز. اهـ. ومثله في المعراج، وظاهره أن ذلك رواية ضعيفة عن أبي يوسف. قال في الشرنبلالية: ولا يفتى بهذا لما فيه من تسليط الظلمة على أخذ مال الناس فيأكلونه اهـ ومثله في شرح الوهبانية عن ابن وهبان (قوله وفيه إلخ) أي في البحر، حيث قال: وأفاد في البزازية أن معنى التعزير بأخذ المال على القول به إمساك شيء من ماله عنه مدة لينزجر ثم يعيده الحاكم إليه، لا أن يأخذه الحاكم لنفسه أو لبيت المال كما يتوهمه الظلمة إذ لا يجوز لأحد من المسلمين أخذ مال أحد بغير سبب شرعي. (إلی قوله) والحاصل أن المذهب عدم التعزير بأخذ المال اھ (4/ 61)۔ واللہ أعلم بالصواب!
