We are engaged in the business of selling second-hand clothing (Landa items), which is imported into Pakistan from other countries. Recently, a friend offered me a container from an auction. Auction goods are those that the government has confiscated. The government seizes such goods whether second-hand clothes or other items, when the importer refuses to pay the customs duties or related expenses.
In such cases, after a specified period, the government confiscates the goods and tries to recover its expenses, which are often greater than the value of the goods themselves, by selling them. Before doing so, the authorities usually contact the original owner to see if he wants to repurchase his goods. If he declines, the goods are then auctioned publicly, and the highest bidder purchases them.
My friend works as a broker for such goods that belong to their original owners. There are many reasons why an importer may fail to clear his goods for example, a sudden increase in customs duty, a rise in the dollar rate, total expenses exceeding the value of the goods, complaints about the shipped items, or sometimes foreign companies sending goods on their own.
Now my question is: Is it permissible for me to purchase such goods from the person who bought them in the government auction?
Note: The person whose goods are confiscated is fully aware of this law; it applies generally to everyone. The port and container system is highly regulated, and the customs duties and expenses for every consignment are well known. When someone’s goods are about to be seized, he is already mentally prepared for it.

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clear that if goods imported from foreign countries are legally permitted and the government has imposed a duty (tax) on them, then since imposing taxes is legitimate for the government in certain circumstances, if this tax is reasonable, necessary, and bearable for the people, and the method of collection is not oppressive, then it is permissible for the government to levy such a tax. In such a case, the importer must pay the tax. However, if the importer fails to pay the tax and, as a result, a fine is imposed on the goods according to the prevailing law, but the importer pays the fine within the stipulated period, then the goods must be returned to the original owner. If the importer does not pay the fine and does not reclaim the goods, the government may auction the goods to recover the tax amount. In such a case, it is permissible for the questioner to purchase the auctioned goods and use them.

مأخَذُ الفَتوی

كما في مرقاة المفاتيح شرح مشكاة المصابيح: وفي شرح السنة: هذا الحديث أصل في الورع، وهو أن ما اشتبه أمره في التحليل والتحريم ولا يعرف له أصل متقدم، فالورع أن يتركه ويجتنبه، فإنه إذ لم يتركه واستمر عليه واعتاده جر ذلك إلى الوقوع في الحرام، فلو وجد في بيته شيئا لا يدري هل هو له أو لغيره فالورع أن يجتنبه ولا عليه إن تناوله لأنه في يده، ويدخل في هذا الباب معاملة من في ماله شبهة أو خالطه ربا، فالأولى أن يحترز عنها ويتركها، ولا يحكم بفسادها ما لم يتيقن أن عينه حرام اھ (5/ 1894)۔
وفى حاشية ابن عابدين: (قوله لا بأخذ مال في المذهب) قال في الفتح: وعن أبي يوسف يجوز التعزير للسلطان بأخذ المال. وعندهما وباقي الأئمة لا يجوز. اهـ. ومثله في المعراج، وظاهره أن ذلك رواية ضعيفة عن أبي يوسف. قال في الشرنبلالية: ولا يفتى بهذا لما فيه من تسليط الظلمة على أخذ مال الناس فيأكلونه اهـ ومثله في شرح الوهبانية عن ابن وهبان (قوله وفيه إلخ) أي في البحر، حيث قال: وأفاد في البزازية أن معنى التعزير بأخذ المال على القول به إمساك شيء من ماله عنه مدة لينزجر ثم يعيده الحاكم إليه، لا أن يأخذه الحاكم لنفسه أو لبيت المال كما يتوهمه الظلمة إذ لا يجوز لأحد من المسلمين أخذ مال أحد بغير سبب شرعي. وفي المجتبى لم يذكر كيفية الأخذ وأرى أن يأخذها فيمسكها، فإن أيس من توبته يصرفها إلى ما يرى. وفي شرح الآثار: التعزير بالمال كان في ابتداء الإسلام ثم نسخ اهـ (4/ 61)۔
وفيه ايضاً: (قوله: أمر السلطان إنما ينفذ) أي يتبع ولا تجوز مخالفته وسيأتي قبيل الشهادات عند قوله أمرك قاض بقطع أو رجم إلخ التعليل بوجوب طاعة ولي الأمر وفي ط عن الحموي أن صاحب البحر ذكر ناقلا عن أئمتنا أن طاعة الإمام في غير معصية واجبة اھ (5/ 422)۔
